Overview

Kasselman Solar, LLC (“Kasselman Solar,” “we,” “us,” or “our”) operates the website located at kasselmansolar.com (the “Website”), an online storefront hosted by Shopify (the “Kasselman Solar Shop” or the “Shop”), and related digital information, content, tools, features, products, and services we make available online (collectively, the “Online Services”). We also provide residential and commercial solar design, installation, and related services under separately executed written agreements (“Installation Services”).

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Online Services, when you request information about or receive Installation Services, or when you otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

1. Scope and Relationship with Shopify

This Privacy Policy applies to personal information we collect or process directly through the Website, through forms and communications associated with the Online Services, through the Shop, and in the course of providing Installation Services.

The Shop is hosted by Shopify Inc. (“Shopify”), which collects and processes personal information about your access to and use of the Shop in order to provide and improve that portion of the Online Services for us. Information you submit through the Shop will be transmitted to and shared with Shopify and with third parties engaged by Shopify, which may be located in countries other than where you reside. Shopify maintains its own privacy notice and privacy portal that describe Shopify’s independent processing of your personal information, including data Shopify processes to improve its overall platform. Depending on where you live, you may exercise certain rights with respect to personal information processed by Shopify directly through Shopify’s privacy portal.

To the extent Shopify acts as our service provider or processor in connection with the Shop, Shopify processes personal information on our behalf and in accordance with this Privacy Policy and our agreements with Shopify.

2. Personal Information We Collect or Process

When we use the term “personal information,” we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with us, where you live, and as permitted or required by applicable law:

  • Contact details including your name, address, billing address, shipping address, property/installation address, phone number, and email address.
  • Financial information including credit card, debit card, and financial account numbers, payment card information, financial account information, transaction details, form of payment, payment confirmation, financing pre-qualification information, and other payment details.
  • Account information including any username, password, security questions, preferences, and settings associated with an account you create with us or on the Shop.
  • Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange, or cancel, and your past transactions.
  • Quote, design, and project information including property address, property characteristics, roof imagery and geometry (including aerial imagery and measurements obtained from third-party services), utility account and electricity usage data, electrical service and main panel information, system preferences (such as system size, equipment selection, battery storage, and EV charging), site survey notes, design proposals, financing preferences, and related information you provide or authorize us to obtain when requesting or receiving Installation Services, including through any online design, configuration, or transaction tools we make available.
  • Communications with us including the information you include in emails, phone calls, text messages, customer support inquiries, chat conversations, social media messages, and other communications with us.
  • Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
  • Usage information including information regarding your interaction with the Online Services, such as pages or screens viewed, links clicked, referring URLs, time spent, and how and when you interact with or navigate the Online Services.
  • Marketing and preference information including your communication and marketing preferences, responses to surveys, and information about events or promotions you engage with.

3. Personal Information Sources

We may collect personal information from the following sources:

  • Directly from you including when you create an account, visit or use the Online Services, submit a contact, quote, financing, or consultation request, communicate with us, execute a Purchase Agreement, or otherwise provide us with your personal information.
  • Automatically through the Online Services including from your device when you use our products or services or visit our websites, and through cookies and similar technologies (see Section 7).
  • From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf (for example, Shopify, payment processors, customer relationship management platforms, scheduling tools, analytics providers, and email delivery services).
  • From our partners or other third parties including utilities (with your authorization), financing partners, equipment manufacturers, incentive administrators (such as NYSERDA), installation subcontractors, and publicly available sources such as property records and mapping data.

4. How We Use Your Personal Information

Depending on how you interact with us or which Online Services you use, we may use personal information for the following purposes:

  • Provide, tailor, and improve the Online Services and Installation Services. We use your personal information to provide the Online Services, perform our contracts with you, process your payments, fulfill your orders, remember your preferences and items you are interested in, send notifications related to your account, process purchases, returns, exchanges, or other transactions, create and manage your account, arrange for shipping, enable you to post reviews, provide a customized shopping experience (such as recommending products related to your purchases), respond to quote and consultation requests, design and deliver Installation Services, coordinate site visits and installations, submit applications for utility interconnection and incentives (such as NYSERDA NY-Sun), and otherwise operate and improve our business.
  • Marketing and advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising, and promotional communications by email, text message, phone, or postal mail, and to show you online advertisements for products or services on the Online Services or other websites, including based on items you previously viewed, purchased, or added to your cart, and other activity on the Online Services.
  • Security and fraud prevention. We use your personal information to authenticate your account, provide a secure payment and shopping experience, detect, investigate, or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and secure our services. If you register an account, you are responsible for keeping your account credentials safe, and we recommend that you do not share your username, password, or other access details with anyone else.
  • Communicating with you. We use your personal information to provide customer support, respond to inquiries, provide effective services to you, and maintain our business relationship with you.
  • Legal and compliance reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies; to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings; and to enforce or investigate potential violations of our terms or policies.

  • With Shopify, vendors, and other third parties who perform services on our behalf. For example, IT management, payment processing, data analytics, customer support, cloud storage, order fulfillment and shipping, CRM and marketing automation, email and SMS delivery, scheduling and dispatch, site-survey and design tools, and identity verification services.
  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify and third-party advertising platforms to support personalized advertising based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites. You can exercise these rights as described in Section 10 below.
  • With parties involved in delivering Installation Services. Including equipment manufacturers, financing partners, utility companies (such as National Grid, NYSEG, and other upstate New York utilities) for interconnection, and incentive or rebate administrators (such as NYSERDA), in each case as necessary to design, install, service, and obtain incentives for your solar or related energy system.
  • When you direct, request, or otherwise consent to our disclosure of certain information to third parties, such as to ship you products, to share reviews or testimonials, or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.
  • In connection with a business transaction such as a financing, merger, acquisition, reorganization, sale of assets, or bankruptcy.
  • To comply with legal obligations (including responses to subpoenas, search warrants, and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Online Services, our rights, and the rights of our users or others.

We do not sell your personal information for money. To the extent any cross-context behavioral advertising or analytics activity described in this Privacy Policy is considered a “sale” or “share” under applicable law, you may opt out as described in Section 10.

6. Cookies and Tracking Technologies

We and our service providers (including Shopify) use cookies, pixels, tags, SDKs, local storage, and similar technologies (collectively, “cookies”) to operate the Online Services, remember your preferences and settings, understand how visitors use the Online Services, secure the Online Services, and support advertising and marketing.

Examples of cookies we and our service providers may use include:

  • Strictly necessary / session cookies required to operate the Online Services (for example, shopping cart and checkout functionality).

The Online Services may provide links to websites or other online platforms operated by third parties, including financing partners, utility websites, incentive program websites, and social media platforms. If you follow links to sites not affiliated with or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on those sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of the Online Services and users of those platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Online Services.

8. Children’s Data

The Online Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details below to request that it be deleted. As of the effective date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

9. Security and Retention of Your Information

We maintain reasonable administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of personal information, consistent with the New York Stop Hacks and Improve Electronic Data Security (SHIELD) Act and other applicable laws. However, no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, including whether we need the information to maintain your account, provide the Online Services or Installation Services, comply with legal and tax obligations (including NYSERDA recordkeeping and long-term warranty and monitoring obligations for installed solar systems), resolve disputes, or enforce other applicable contracts and policies.

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline your request as permitted by law.

  • Right to Access / Know. You may have a right to request access to personal information that we hold about you.
  • Right to Delete. You may have a right to request that we delete personal information we maintain about you.
  • Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
  • Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  • Right to Opt Out of Sale, Sharing, or Targeted Advertising. Depending on where you reside, you may have a right to opt out of the “sale” or “share” of your personal information or to opt out of processing of your personal information for purposes considered to be “targeted advertising,” as defined in applicable privacy laws. You can exercise these rights by contacting us using the details below, by using any opt-out link provided in our marketing communications, or by enabling GPC as described in Section 6.
  • Managing Communication Preferences. We may send you promotional emails, and you may opt out of receiving them at any time by using the unsubscribe option in our emails or by contacting us. For SMS/text messages, you may opt out by replying STOP to any message. If you opt out of marketing communications, we may still send you non-promotional messages about your account, orders, installations, warranty, or service.

We will not discriminate against you for exercising any of these rights. We may need to verify your identity before processing your request, as permitted or required under applicable law. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf. Before accepting a request from an agent, we will require proof that you have authorized the agent to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

12. International Transfers

We are based in the United States, and we primarily operate in upstate New York. Please note that we may transfer, store, and process your personal information outside the country where you live. If we transfer your personal information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms such as the European Commission’s Standard Contractual Clauses, or any equivalent contracts issued by the competent authority of the United Kingdom, unless the transfer is to a country that has been determined to provide an adequate level of protection.

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the Website, update the “Last updated” date at the top, and provide notice as required by applicable law. Your continued use of the Online Services after the effective date of any update constitutes acceptance of the updated Privacy Policy to the extent permitted by applicable law.
